Portugal: major legislative change
In Portugal, there has been an important change to Legislative Decree 102-D / 2020 of December 10, 2020. Article 14, numbers 7, 9 and 10 relating to visible fees has been adapted. It does not apply to packaging and packaging waste, and portable batteries, and charges do not need to be reported. For WEEE and industrial batteries, the visible charges must be shown on the invoices.
Since July 1, 2021, new regulations for online retailers have applied to the registration of packaging in Finland. Companies that place packaging materials on the Finnish market now have to register as manufacturers and participate in the extended manufacturer responsibility system.
The new legislation concerns manufacturer responsibility for packaging and is addressed to the following types of companies with a turnover of at least € 1 million:
Finnish company that packs products (themselves or through a subcontractor) in Finland for the Finnish market
Finnish companies that import packaged products into the Finnish market (including imports for their own use)
Foreign companies selling packaged products through online channels to users in Finland
These companies must register from July 1st, 2021 as part of the extended manufacturer responsibility.
In Germany, the law is intended to ensure uniform market surveillance for non-food products, harmonized or not, across Europe. In addition to our webinar, you will find all the important information about the new Market Surveillance Act on our website.
At the beginning of 2022, the new ElektroG 3 (ElektroG3) will come into force and bring many new obligations for operators of electronic marketplaces and fulfillment service providers. The best-known marketplaces on the German market include Amazon, eBay and Kaufland. With the new electrical law, electrical devices from unregistered manufacturers are no longer allowed to be offered on the platforms.
The Berlin tax office in the Neukölln district is currently almost overrun by traders from China. They must apply for a sales tax identification number. According to the tax office, up to 1,500 new applications are received every week. Since 2019 online retailers need a tax ID in order to offer goods on European internet platforms such as Amazon or eBay. So far, however, most Chinese traders have traded past the tax office. However, through tighter enforcement and higher penalties, these traders are now also being forced to act.
For retailer´s own brands as well as sales associated with imports, registrations must be made with the EAR Foundation by the end of 2021. More than 100,000 new EAR registrations for over 20,000 manufacturers are expected by the end of the current year. Should this number of new manufacturers prove to be true, this would roughly double the number of manufacturers already registered (as of November 2020, source: EAR).
