The new german Packaging Act 2 (VerpackG2) came into force on July 3, 2021 and brings many new obligations for manufacturers, online retailers, logisticians and pretty much everyone involved in the value chain of non-food products.

In our newsletter 2/2021 we already informed you about the latest developments regarding the French Triman logo. As a new decree was recently published, there is again news on the French packaging regulation. In addition, a decision by the French Council of State to ban the signs of other recycling systems is still pending. This decision can take anywhere from 6 to 18 months (as of March 2021).
Exceptions to the physical identification of the Triman logo and the sorting information are permitted under special conditions:
If the surface of the larger side of a product or its packaging is less than 10 cm² and no other document is supplied with the product, the Triman logo and the sorting information can be digitized (QR code, web)
If the area is between 10 and 20 cm² and there are no accompanying documents, the Triman logo must be attached. The sorting instructions can be digitized.
Renewed extension of the transition period for implementing the sorting information
After the sorting instructions have been announced, there will be a 12-month transition period during which the products must be labeled with the Triman logo and the sorting instructions.
Products that were manufactured or imported before the end of the 12-month transition period can still be marketed 6 months after the end of the transition period.
The French toy association is currently working on the establishment of a waste management system for toys, which should be ready for use by January 1, 2022 at the latest.

The german Packaging Act, which is intended to ensure the highest possible recycling rate for packaging, has been in force since 2019. After two years of validity, a comprehensive amendment to the law has been decided. Comprehensive obligations for online platforms, retailers and logisticians has come into use since July 3, 2021.
