The German parliament passed a new supply chain law in 2021. The official name of the law is the Supply Chain Sourcing Obligations Act (LkSG). In our actual blog post we will explain which rights and obligations the law contains and whether there is a need for action for you as a company.
Mandatory deposit for batteries proposed in EU Parliament
Last week, a draft with a total of 108 amendments to the EU Commission's proposed regulation was presented. Among other things, it provides for the mandatory introduction of deposit systems for all general-purpose batteries by the member states. The deposit systems are intended to create an incentive for private consumers and other end users to maximise the return of spent batteries and promote their recycling.
In addition to the mandatory deposit system, a ban on the export of battery waste will be required. This should help to recycle all spent batteries within the EU and keep their raw materials in the EU internal market. The aim should be to be able to use them in the production of new batteries.
UPDATE: The Triman Logo in France
The French government is still in discussions on the implementation of the labelling by the French Triman logo. To keep you up to date on this topic, we expand our information article as soon as there are new findings. In this article, you will learn everything you need to know about the Triman logo on the one hand, and on the other hand, what you as a manufacturer or seller have to pay attention to in the future.
Amazon is currently contacting all sellers selling to Germany or France who could be identified as a manufacturer. The subject of this contact is to check the implementation of the regulations regarding Extended Producer Responsibility (EPR). Non-compliant manufacturers will be removed from the platform. As a marketplace and fulfilment service provider, Amazon is obliged to check the legal compliance of its merchants in order not to be held liable itself.
Every distributor who is also considered a manufacturer within the meaning of the Packaging Act or the Electrical and Electronic Equipment Act must prove the corresponding registration numbers to Amazon. In perspective, this verification will probably also be implemented for the Battery Act.

As sanctions for non-compliant offers, Amazon announces the exclusion of the merchant from the platform. This means that all offers of a non-compliant merchant will be removed from the platform. In the case of packaging, the sanctions will apply to all offers from 1 July 2022, and in the case of electrical and electronic equipment, to all offers from 1 January 2023.
