in the last weeks, we have received an increasing number of enquiries regarding marketplaces such as Amazon and eBay. These are legally obliged to obtain certain information from their traders. This includes the EPR registration number.
In our newsletter 13/2021 we explain what Amazon means by an EPR registration number and how you can get one.
Furthermore, you will learn how you, as a foreign trader, can easily have your obligations regarding the Packaging Act handled by an authorised representative in Germany.
We hope you enjoy reading the newsletter and look forward to your feedback.

How to handle the obligations of the German Packaging Act with an authorised representative
Since July 2021, you are able to process all obligations, except the registration in the German packaging register LUCID, through an authorized representative in Germany. This will make it easier for foreign companies to act in a legally compliant manner on the German market. We inform you about all aspects of the authorisation and how you can implement it with the packaging register LUCID.
Switzerland: VREG applies to all electrical and electronic equipment from 1.1.2022
At its meeting on 20th October 2021, the Swiss Federal Council approved amendments to the Ordinance on the Return, Take-Back and Disposal of Electrical and Electronic Equipment (VREG). The amended requirements of the VREG now apply to all electrical appliances. This improves the recycling of the materials contained therein.
The adaptation of the Ordinance contributes to strengthening the recycling of waste equipment and thus to closing the resource cycle. The scope of the ordinance is to be extended to all electrical and electronic equipment. This includes, in particular, medical devices, monitoring and control instruments, dispensing machines and photovoltaic modules, which will in future fall under the VREG.
As the requirements of the VREG now also apply to equipment from vehicles, buildings and objects whose removal is possible with a reasonable effort, the potential for recovering recyclable components is also increased.
The amended ordinance will come into force on 1 January 2022.

What do marketplaces understand as an EPR number and how do you get it?
Extended Producer Responsiblity "EPR" is on everyone's lips right now. Amazon is currently obliging its dealers identified as producers to submit an EPR registration number. This primarily affects retailers who put all types of packaging, electrical and electronic equipment and batteries on the market. We explain what Amazon means by an EPR registration number and how you can get it.
Germany has clearly missed the minimum targets for the collection of WEEE in 2019. The Federal Government reported a collection rate of 44.3 percent to the EU Commission in Brussels. Germany was thus far from the minimum quota of 65 per cent that first applied for 2019. Improvements are expected with the amendment of the Electrical and Electronic Equipment Act in 2022.
In 2019, 947,067 tonnes of waste electrical and electronic equipment were collected by municipalities, dealers and manufacturers in Germany, according to a recent evaluation by the Federal Environment Agency (UBA). This corresponds to the reported collection rate of 44.3 percent. The minimum collection target of 65 per cent, which has been in force in all EU countries since 2019, was missed by Germany by a significant margin (around 443,000 tonnes).
The amended Electrical and Electronic Equipment Act (ElektroG) provides for new obligations to take back old electrical equipment and better information for consumers from 2022 in order to increase the collection volume. However, more time will pass before the amendments are reflected in the figures. Trade, manufacturers and municipalities must also get more involved and further improve collection and take-back options, for example through more accessible recycling centres or more flexible acceptance times.
