Authorisation under EWKFondsG for foreign companies in Germany

The final adoption of the new EU Packaging and Packaging Waste Regulation will not be presented in the European Parliament this week as previously planned.
The procedure stipulates that the regulation is deemed adopted if no political group or at least 5% of MEPs request a vote within 24 hours of the announcement. If there are no objections, there is no need for a further vote in Parliament.
Following this adoption at the parliamentary level, the Council of the European Union must still formally approve it. As soon as the Council has adopted the regulation, it will be published in the Official Journal of the European Union.
The regulation will officially enter into force 20 days after publication.
However, companies will have a transition period of 18 months before the new rules actually have to be implemented.
EU: New labeling requirements for communication equipment
Directive (EU) 2022/2380 extends the rules for the sale of radio equipment, such as mobile phones, tablets and other devices with radio functionality. This regulation requires labelling to ensure that consumers are better informed when purchasing radio equipment.
From 28 December 2024, the new requirements must be met for most devices.
For laptops, the rules will come into force later, on 28 April 2026.
Scope and affected products
The regulation covers radio equipment such as mobile phones, tablets, headphones, speakers, e-readers and many other portable devices. New labelling requirements apply to all these products.
New labelling elements
Pictogram for the power supply: Retailers must indicate on the packaging or near the price in online shops whether a power supply is included. This must be clearly displayed using a special pictogram. It is not sufficient to display the pictogram via an external link.
Information on charging function and compatible power supplies: An additional label must inform consumers about the charging functions of the device and the compatible power supplies. This label must also be placed in a clearly visible position on the packaging or, in the case of online offers, near the price.
Option to purchase without a power supply: Retailers must offer customers the option to purchase the devices without a power supply if they have the devices including the power supply in their range.
Consequences of non-compliance:
If the requirements are not met, the market surveillance authorities can take measures that go as far as prohibiting sales. Since the rules are considered market behaviour rules, violations can also be punished and warned against as competition violations.

EU: Product Safety Regulation - Obligation for online marketplace providers
The Product Safety Regulation, which comes into force on 13 December, sets out new requirements specifically for e-commerce to strengthen consumer protection and ensure that consumers in the EU have safe access to products via online platforms.
Affected parties
The regulation affects all economic operators, including manufacturers, authorised representatives, importers, distributors. Online marketplace providers are not themselves economic operators (i.e. neither manufacturers nor distributors) according to the regulation. However, if the online marketplace provider also manufactures or sells products itself, it must also fulfil the corresponding obligations of a manufacturer or distributor in addition to the general platform obligations.
Obligations for online marketplace providers:
Platforms such as online marketplaces that enable consumers to conclude contracts with companies for the purchase of products have specific obligations under the regulation. These include:
Central point of contact: The platform must designate a point of contact for market surveillance authorities and consumers in order to be able to respond quickly to enquiries.
Rapid implementation of official measures: If market surveillance authorities order the removal of dangerous products or warnings, for example, the platform must normally implement this within two days.

Spain - EPR for packaging: Labelling will be mandatory from January 2025. All packaging must be clearly visible and legibly labelled with a pictogram indicating the intended disposal container.
Germany – Stiftung ear: Stiftung ear has announced that no new fee regulation will come into force on 1 January 2025. The fees will not be adjusted until August 2025 and will be linked to the amendment of the Battery Act.
