EU Battery Regulation approved - What you need to know!
It's official: the EU Battery Regulation has been passed. On June 14, 2023, the proposal received 587 votes in favor, 9 votes against, and 20 abstentions.
Key measures under the regulation for your reference
Mandatory declaration and labeling of the CO2 footprint for electric vehicles (EV) batteries, light means of transport (LMT) batteries (e.g. for electric scooters and bikes), and rechargeable industrial batteries with a capacity above 2kWh;
Easy removal and interchangeability of device batteries by consumers;
Introduction of a digital battery passport for certain types of batteries;
Due diligence strategy for all economic operators, except SMEs;
Tougher collection targets for battery waste;
Minimum quantities of recovered materials from used batteries: lithium - 50% by 2027 and 80% by 2031; cobalt, copper, lead and nickel - 90% by 2027 and 95% by 2031;
Minimum content of recovered substances from battery and consumer waste for use in new batteries: eight years after the entry into force of the regulation - 16% for cobalt, 85% for lead, 6% for lithium and 6% for nickel; 13 years after the entry into force: 26% for cobalt, 85% for lead, 12% for lithium and 15% for nickel.
When will the EU Battery Regulation come into effect?
While the regulation has been passed, it has not yet come into effect. This will happen once the Council formally approves the text.

Act now: Germany's revised minimum standard for packaging recycling
Germany is taking a significant step towards enhancing the recyclability of packaging. The Foundation Central Agency Packaging Register (Stiftung Zentrale Stelle Verpackungsregister - ZSVR) is currently in the process of revising the minimum standard for assessing the recycling-friendly design of packaging for the 2023 edition. The aim is clear: to ensure that only genuinely recyclable packaging is classified as such.
Implications for affected companies
Your voice matters! The consultation process for the minimum standard for packaging design for recycling, 2023 edition, is now underway, running from June 5 to July 14, 2023. As a company involved in the manufacturing or use of packaging in Germany, your voice matters, and you have a valuable opportunity to submit your comments on the current draft.
The comments can be sent to the Central Agency Packaging Register (ZSVR) by mail or preferably electronically to konsultationsverfahren@verpackungsregister.org.
Written submissions on the current draft may be made by Friday, 14 July 2023.
After the completion of the process, the standard will be revised and published on September 1, 2023.

Introduction of extended producer responsibility (EPR) for packaging in Denmark from 2025
Denmark is on the verge of implementing the current EU Packaging Directive, becoming the final EU country to do so. The operational system will come into effect on January 1, 2025. A law has been passed and adopted, but we are still awaiting the regulatory framework. The regulation will provide detailed provisions on which companies are obligated to register, report, assume financial responsibility, and distribute tasks among the parties. It is expected that the regulatory framework will be completed during the course of 2023.
Financial and Administrative Challenges for Companies
An important change is that the operational system from January 1, 2025, must be fully financed through fees from manufacturers and distributors, as well as revenues from the sale of packaging materials by collectors.
This new financing method will undoubtedly have significant financial and administrative implications for companies. It is crucial for companies to prepare for these changes early on to address potential challenges and ensure compliance.
