France: Producer responsibility for building materials and furniture from 2023 on
France will get a new EPR for building materials and construction materials in 2023. The take-back systems responsible for this were published by the Ministry in the Official Gazette last week.
Extended producer responsibility is divided into the 2 main categories.
Category 1: non-inert substances
Category 2: Inert substances
The 4 approved systems are to operate in binomials consisting of both categories in the future.
Manufacturer responsibility for furniture
On 03 July 2022, an extension of the EPR furniture was announced in the Official Gazette of the French Government. Now we have the official notification of the take-back system:
From 01.01.2023, finished removable products, based on natural or synthetic textiles, as well as their accessories, regardless of the material and which, serve to decorate and design walls, floors and windows, belong to the EPR furniture. These products are primarily carpets, rugs, curtains & drapes, as well as their accessories.
Under the international WEEE EU Directive, manufacturers and dealers are also obliged to register solar or photovoltaic modules with the Stiftung EAR in Germany.
These are assigned to the group of so-called “dual-use devices” and come, depending on the size of the module, under category 4 or 5.
Currently, the required collection rate for photovoltaic modules is 85%, whereby 80% must be returned to the materials cycle.

Recycling rate for e-cigarettes must increase significantly
Manufacturers and distributors of e-cigarettes are subject to the same obligations as for all other electrical devices.
E-cigarettes and disposable e-cigarettes are battery-powered electrical devices that must be disposed of properly at the end of their useful life. Distributors of e-cigarettes have an obligation to ensure an increase in the collection rate in the future.
Currently, almost 50 percent of electronic cigarettes are not correctly disposed of and recycled. The massive waste of the lithium-ion batteries used is particularly serious.
E-cigarettes, like any other waste electrical equipment, must be disposed of correctly and fed into the recycling loop. Manufacturers and distributors are therefore obliged to register them with the ear foundation and to comply with all other obligations in the course of extended producer responsibility.
