EPR Obligations in Sweden: What's Changing in November 2023?
The producer responsibility in Sweden encourages manufacturers to develop environmentally friendly and easily recyclable products. This has been in place since the 1990s and applies to various product categories, from packaging to automobiles. The specific requirements vary by product category.
Manufacturers must design and label their products for recyclability, collect the product when it becomes waste, manage or recycle it, and report information to the Swedish Environmental Protection Agency.
As of November 2023: What's Changing?
Approved Producer Responsibility Organization
Until now, manufacturers had a clear rule: they needed to be connected to appropriate collection systems to ensure the proper disposal of their packaging. However, this is changing as of November 1, 2023.
Instead of a collection system, manufacturers must now appoint an approved producer responsibility organization. If your company is already connected to a collection system, it's crucial to ensure that the Swedish Environmental Protection Agency has approved it as a producer responsibility organization. If not, you are obligated to appoint an approved organization.
EPR for Balloons in Sweden
Starting in November 2023, producer balloons must register with the Swedish Environmental Protection Agency. From 2024, they must annually report the number of products sold. The goal is to reduce pollution from balloons and disposable products.
Who is considered to be a producer?
A producer of balloons is defined as one who professionally:
brings in balloons to Sweden
manufactures balloons in Sweden, or
from a country other than Sweden sells balloons to an end user in Sweden.
To fulfill producer responsibility, balloon producer must pay environmental fees. These fees consist of a fixed annual fee and a variable product fee. The aim is to involve manufacturers in the cleanup costs of disposable plastic products. Violations of producer responsibility and reporting requirements can result in fines of up to 10,000 SEK.

The Spanish Packaging Law takes packaging manufacturers to task from 2023 onwards. With the new law, Spain is implementing the EU Directive 2018/852 from 2018 into national law after a lengthy process. In the implementation of the EU Directive, Spain takes its own course in some respects compared to the Directive and other EU Member States. For example, at the beginning of 2023, foreign companies were surprised by the Spanish Ministry of the Environment (MITECO)’s requirement to apply for a special tax number. The Spanish tax number for non-resident companies (NIF) is required to register in the packaging register. These and other obligations pose challenges for companies.

Important Update: Postponement of Packaging EPR Implementation in Denmark
On October 5, 2023, the Danish Ministry of the Environment announced that the implementation of extended producer responsibility (EPR) for packaging in Denmark is expected to be postponed to July 1, 2025.
Postponement of the registration deadline
The postponement of the effective date of the EPR for packaging also impacts the registration deadline, which was originally scheduled for the first quarter of 2024. The new registration deadline is now April 1, 2024.
Was muss registriert werden?
The registration process remains the responsibility of the Danish Producers Association (DPA). Companies affected by the EPR must register in the central producer register, selecta packaging collection system and report the expected marketed packaging volumes for the entire year 2024.
